Foreclosure Case Dismissed in New York County
Erin E. Wietecha, of counsel, argued in New York County in November 2018 on behalf of a borrower who opposed a bank’s motion for summary judgment, and cross-moved against the bank and asked the Court to dismiss the bank’s foreclosure action on the basis that the foreclosure case was filed after the statute of limitations had expired. On September 30, 2019, the Court ruled in favor of the borrower and dismissed the bank’s foreclosure case, with prejudice, which means that the bank is not permitted to bring another foreclosure action with respect to that loan.
