On the heels of a recent victory in New York County, in which the judge dismissed the bank’s foreclosure case on the basis that it was filed outside of the statute of limitations, Erin E. Wietecha was recently hired to pursue a “quiet title” action against the bank. In a quiet title action, the homeowner can ask the court to wipe out the mortgage — in legal terms, the court can order that the mortgage must be stricken from the land records if, for example, it is no longer enforceable.
